BOMBAY HIGH COURT REAFFIRMS RIGHT TO PEACEFUL PROTEST, CALLS FOR FAIR SCRUTINY OF PROTESTERS

October 19, 2026

The Bombay High Court has underscored that peaceful protest is a fundamental right, while emphasising that the credentials and background of those seeking permission to demonstrate must also be considered by the authorities.

The court’s observations highlight the importance of balancing citizens’ democratic freedoms with legitimate administrative and public-order requirements. Peaceful demonstrations remain an essential means through which individuals and groups express dissent, raise grievances and hold public institutions accountable.

At the same time, the court indicated that authorities must assess the circumstances surrounding a proposed protest rather than treat every application identically, taking into account the applicants’ credentials and other relevant considerations.

The observations bring renewed attention to the relationship between constitutional freedoms and the regulation of public demonstrations in India. The central challenge for the administration remains ensuring that reasonable restrictions do not become arbitrary barriers to legitimate dissent.

The ruling reinforces the significance of peaceful assembly in a democratic society, where the right to question authority must coexist with lawful measures to maintain public order.
