SUPREME COURT FLAGS LAW ENFORCEMENT FAILURES IN DELHI MINOR GANG-RAPE CASE

September 28, 2026

The Supreme Court has expressed concern over recent sexual assault cases in Delhi and the National Capital Region, observing that the alleged gang rape of a minor has exposed serious failures in law enforcement. The court drew parallels with the 2012 Nirbhaya case, which triggered nationwide protests and renewed scrutiny of women's safety and policing in India.

A bench led by Justice J.B. Pardiwala took suo motu cognisance of recent rape cases, including the alleged gang rape of a minor aboard a sleeper bus. The court observed that the incidents bore painful similarities to the 2012 Delhi gang rape, highlighting concerns about the prevention of sexual violence and the response of law enforcement agencies.

The 2012 Nirbhaya case involved the gang rape and brutal assault of a 23-year-old woman aboard a moving bus in Delhi on December 16. She later died from her injuries, prompting widespread public demonstrations and demands for stronger measures to address sexual violence and improve the criminal justice system.

The Supreme Court's intervention comes amid investigations into multiple recent cases of sexual violence in Delhi and neighbouring areas. In a separate incident, a 17-year-old girl was allegedly gang-raped by three men at Aastha Kunj Park near Kalkaji in south Delhi. Police have conducted search operations, recorded witness statements and intensified patrols in areas identified as vulnerable.

The court's observations have renewed attention on the responsibilities of law enforcement agencies in preventing sexual offences, responding promptly to complaints and ensuring the safety of women and minors. The cases remain subject to investigation and judicial proceedings
