SUPREME COURT PUTS ELECTION COMMISSION UNDER JUDICIAL SPOTLIGHT OVER PLEA AGAINST POLL PANEL

October 5, 2026

NEW DELHI — The Supreme Court has issued notices to the Election Commission and the Centre on a petition challenging the functioning of the poll panel headed by Chief Election Commissioner Gyanesh Kumar.

The petition has brought the composition and functioning of the Election Commission before the apex court, with the petitioners seeking judicial intervention over several concerns relating to the country's electoral machinery.

The court's decision to seek responses from the Election Commission and the Union government marks the beginning of a judicial examination of the issues raised in the petition. The notices require the concerned authorities to respond to the allegations and legal arguments placed before the court.

The challenge comes amid continuing political and legal debate over the independence, accountability and functioning of the Election Commission. Questions surrounding electoral processes, institutional safeguards and the role of constitutional authorities have increasingly become matters of public and judicial scrutiny.

The petition has specifically targeted the poll panel under the leadership of Gyanesh Kumar, placing the functioning of the constitutional body at the centre of the latest legal challenge.

The Supreme Court's notice does not amount to a finding against the Election Commission or the Centre. The respondents will now have an opportunity to present their position before the court as the matter proceeds through the judicial process.
